1. Acceptance of Terms

BetTrading.net is a service operated by JIA Software Limited, a company registered in England and Wales under company number 11905293, whose registered office is at Belmont Suite, Paragon Business Park, Chorley New Road, Horwich, Bolton, England, BL6 6HG. In these Terms, "we", "us" and "our" mean JIA Software Limited.

By registering for an account, accessing, or using BetTrading.net ("the Service"), including our website and desktop application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated to you, and your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

These Terms apply to all users, visitors, and anyone else who accesses or uses the Service. Please read them carefully before proceeding.

2. Description of Service

BetTrading.net is a subscription-based platform that provides users with access to a desktop trading application. The Service includes:

Access to our website (www.bettrading.net)
A desktop application for trading purposes
Account management and subscription services
Help articles and support resources
Periodic updates, features, and improvements

The availability and functionality of the Service may vary depending on your subscription tier (Basic or Pro). We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Eligibility and Account Registration

3.1 Age Requirement

By using BetTrading.net, you confirm that you are at least 18 years of age. We do not permit users under 18 to create accounts or use the Service. If we discover that you are under 18, we will immediately terminate your account and delete your personal data.

3.2 Account Registration

To access the Service, you must create an account by providing:

A valid email address
A secure password
Age confirmation (18+)
Acceptance of our Privacy Policy and Terms of Service

That is the whole of it. We do not ask for your name at registration. Your account has one optional display name, which you may add later from your account settings: it greets you inside the application and nothing else depends on it, it need not be your real name, and you can change or clear it whenever you like. (Our pre-launch mailing list does ask for a name; that is a separate record, not an account, and our Privacy Policy explains what it holds.) Your country of residence is optional and is not part of registration: you may add it later from your account settings, where it determines the tax treatment applied to a Pro subscription.

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information when registering and to update this information promptly if it changes. We reserve the right to suspend or terminate accounts with false or misleading information.

4. Subscription Plans and Pricing

4.1 Available Plans

BetTrading.net offers the following subscription tiers:

Pro (£10/month inc. VAT):

Full access to the desktop application, with every exchange we support connectable at the same time
All features and functionality unlocked, including the ladder view, the multi-market dashboard, automation rules, partial Trade Out and your complete trading history
Recurring monthly billing
Cancel, pause, or resume the subscription at any time

Basic (Free):

Full access to the desktop application, with one exchange connected at a time
Live market view, manual betting, full-position Trade Out, today's profit and loss, and the last 30 days of trade history
Free permanently. It is not time-limited and it does not expire

4.2 Pricing and Billing

Pricing for the Pro subscription is £10 per month (inclusive of VAT/GST). Pricing may be adjusted at our discretion, with at least 30 days' notice to users. Your continued use of the Service after a price change constitutes acceptance of the new price.

4.3 Billing and Payment

Subscriptions are managed and processed by Paddle, our payment processor. By subscribing, you authorize Paddle to charge your payment method on a recurring monthly basis. You are responsible for ensuring that your payment information is current and valid.

4.4 Failed Payments

If your payment fails:

Your subscription status will be marked as "Past Due"
You will have 24 hours to update your payment method
If payment is not resolved within 24 hours, your subscription will be downgraded to Basic
You may reactivate your Pro subscription at any time by providing updated payment information

4.5 Refunds and Your Right to Cancel

Subscription fees are non-refundable once a billing period has started, except where the law gives you a right to a refund, and except in the circumstances set out in our Refund Policy. The Refund Policy forms part of these Terms; where these Terms and the Refund Policy differ, the Refund Policy governs refunds.

Your 14-day right to change your mind. If you are a consumer in the United Kingdom, the European Union or the EEA, you have a statutory right to withdraw from your purchase of a digital service within 14 days of your first subscription payment, without giving a reason. Because the Service is supplied to you straight away, you may be asked at checkout to consent to supply beginning during those 14 days and to acknowledge that, once supply has begun, the withdrawal right may be lost, or any refund may be reduced proportionately to reflect what has already been supplied. This right applies to your first subscription payment, not to later renewal payments. Consumers in some other countries have equivalent rights over different periods; where such a right cannot be excluded by agreement, it applies and nothing here reduces it.

How to exercise it. Tell us, or Paddle, before the 14 days are up. You may contact either Paddle's Order Support team, as our Merchant of Record, or us directly at support@bettrading.net — you are not required to go through Paddle. Any clear statement of your decision to withdraw is enough; you may use the model cancellation form in Section 4.7 but you do not have to. Approved refunds are returned by Paddle to your original payment method.

Cancelling is not the same as withdrawing. You may cancel your subscription at any time. Cancelling stops future charges and leaves your access in place until the end of the period you have already paid for; it does not by itself create a refund of amounts already paid.

Our Refund Policy sets out the full position, including the circumstances in which we will always put things right. Nothing in these Terms affects your statutory rights as a consumer.

4.6 Pause and Resume

Pro subscribers can pause their subscription at any time through their account dashboard. While paused, you will have access only to Basic features, and you will not be charged. You can resume your Pro subscription at any time.

4.7 Model Cancellation Form

You do not have to use this form. If you would like to, complete it and send it to support@bettrading.net, or to Paddle's Order Support team, to exercise the 14-day withdrawal right described in Section 4.5.

5. User Conduct and Prohibited Activities

You agree not to engage in any of the following activities while using the Service:

Violate any applicable laws, regulations, or third-party rights
Attempt to gain unauthorized access to the Service, other accounts, or systems
Transmit malware, viruses, or harmful code
Engage in harassment, threats, or abusive behavior toward other users or BetTrading.net staff
Spam, phishing, or other deceptive practices
Reverse-engineer, decompile, or attempt to extract the source code of the Service
Use the Service for commercial purposes without authorization
Interfere with or disrupt the Service's infrastructure or servers
Scrape or automatically collect data from the Service
Share your account credentials with others or allow others to use your account
Use the Service in any way that violates these Terms

We reserve the right to investigate violations and take appropriate action, including suspension or termination of your account.

6. Intellectual Property Rights

6.1 BetTrading.net Content

All content, designs, code, features, and functionality of the Service (including the website and desktop application) are owned by BetTrading.net or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, reproduce, or distribute this content without our prior written consent.

6.2 User License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal use, subject to these Terms. This license does not include the right to:

Reproduce or copy any content
Sell, resell, or lease access to the Service
Modify or create derivative works
Remove any copyright, trademark, or proprietary notices

6.3 Your Content

If you upload, submit, or provide any content to the Service, you retain ownership of that content but grant us a worldwide, royalty-free license to use, reproduce, display, and distribute your content for the purpose of operating and improving the Service.

7. Disclaimers and Limitations of Liability

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

The Service will be error-free or uninterrupted
The Service will meet your specific requirements
Any defects will be corrected
The Service will be compatible with all devices or networks

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BetTrading.net SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.

7.3 Acknowledgment

You acknowledge that these limitations are essential terms of this agreement and that we would not provide the Service without them.

8. Indemnification

You agree to indemnify, defend, and hold harmless BetTrading.net, its owners, operators, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your violation of these Terms
Your violation of any applicable law or regulation
Your infringement of third-party intellectual property rights
Your use of the Service in an unauthorized or prohibited manner
Any content you submit or provide to the Service

9. Termination

9.1 Termination by You

You may terminate your account at any time by logging into your account settings and selecting the cancellation option. Upon cancellation:

Your Pro subscription is cancelled with effect from the end of your current billing period — you are not charged again, and you keep Pro access for the period you have already paid for
At the end of that period your account reverts to Basic
You may request your data be deleted in accordance with our Privacy Policy

9.2 Termination by BetTrading.net

We may terminate or suspend your account at any time, with or without cause, including if we believe you have violated these Terms. Reasons for termination may include:

Violation of these Terms or our policies
Engagement in illegal activities
Abuse or harassment of other users or staff
Payment fraud or chargebacks
Age confirmation failure (under 18)

Upon termination, your right to use the Service will immediately cease, and you will lose access to your account.

9.3 Effect of Termination

Termination does not relieve you of your obligation to pay any outstanding fees or charges. After termination, we may delete your account and associated data in accordance with our Privacy Policy.

10. Modifications to Terms and Service

We reserve the right to modify these Terms, our pricing, or the Service at any time. We will notify you of material changes via email or by posting a notice on the website. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

We may also discontinue or modify any feature, functionality, or subscription tier of the Service. To the extent permitted by law, such modifications will not entitle you to a refund or compensation.

11. Third-Party Services

The Service may integrate with third-party services, including Paddle (payment processing) and Google Analytics. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for:

The availability, accuracy, or functionality of third-party services
Any losses or damages arising from your use of third-party services
Third-party privacy practices or data handling

Please review the privacy policies and terms of service of any third-party services before using them.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales.

12.1 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us at support@bettrading.net to attempt to resolve any dispute informally.

12.2 Jurisdiction and Venue

The courts of England and Wales have jurisdiction over any dispute arising from these Terms or your use of the Service.

If you are a consumer, this does not take away rights you have where you live. Specifically:

If you live in Scotland or Northern Ireland, you may bring proceedings in the courts of that country, and you keep the benefit of any mandatory consumer-protection rules that apply there.
If you live outside the United Kingdom, you keep the benefit of any mandatory consumer-protection rules of your country of residence that cannot be overridden by agreement.
Nothing in these Terms affects your statutory rights as a consumer.
